Case Selection Update February 7, 2013

The Case Selection Committee met this morning and selected 2 new cases for amicus briefing: 

The first is Farrar v. Georgia-Pacific (PLAC # 13-107) before the Maryland Court of Appeals (MD's court of last resort).  In this case a granddaughter was allegedly exposed to asbestos by washing you grandfather's clothes after he worked in a construction zone where dry wall was being sanded.  PLAC will be briefing the scope of the warning due to bystanders of bystanders.  PLAC's brief will be authored by Terri Reiskin, Dykema, Washington DC.

The second case is Colombo v. Bombardier Recreational Products (PLAC # 13-103) before the CA Fourth Court of Appeals.  In this case 2 young girls were injured when they slid off the back of a Sea-Doo jet ski.  A jury found that there was no defect in the product design, but did find that the warnings provided were defective and assessed compensatory and punitive damages.  The plaintiffs were also permitted to introduce evidence of 20 other incidents without any meaningful review for substantial similarity.  PLAC's amicus brief will be authored by Jonathan Hoffman, Martin Bischoff, Portland, OR.
